Hello, my name is Brandon Davies. I'm a criminal defense lawyer based out of Overland Park, Kansas. In this video, I'm going to be talking a little bit about the DUI context and what is ADC 70 implied consent advisory. Now, if you've ever heard this term, you've probably been arrested for a DUI. You've been pulled off the side of the road, put into a police car, taken down to a police station, and an officer is asking you to take what they call an evidentiary breath test or an Intoxilyzer 9000 test. Before an officer can do that, they have to essentially educate you a little bit. They have to tell you about your rights as a citizen and your rights to not take the Intoxilyzer 9000 test. This form is the DC 70 implied consent advisory. It's going to tell you some of your rights associated with taking the breath test or not taking the breath test. Now, you must be given these instructions or given this information before you are asked to take the test. After they've done the protocols for the 9000, they're going to read through the DC 70 implied consent advisory. If an officer fails to provide you with this DC 70 and fails to provide you with adequate instructions on whether you have to take this test or not, then you may have very strong grounds to suppress the evidentiary breath test before it comes into court.
