Hi, this is my Gator. Welcome to my webisode. I like to call it "Mike on Miranda". I have received a lot of questions about Miranda warnings. People want to know more about it. It boils down to a simple concept: if you are in police custody and being questioned by the police, they must read you your Miranda rights. If they fail to do so and you end up giving a statement, the remedy for their failure is the suppression of the statement. This means that the statement cannot be used as evidence in your case. However, it does not guarantee dismissal of your case. We will need to find another way to attack and beat your case without relying on your statement. If you have been read your Miranda rights, invoke them. If you haven't been read your Miranda rights, still invoke them. There is no reason for you to talk to the cops. Let me do the talking for you.
