Music. Hi, this is Mike Haber. Thank you for asking me what cyberstalking is in the state of Florida. Cyber stalking is stalking by way of technology, just like stalking and aggravated stalking. Cyber stalking refers to the willful, malicious, and repeated acts of harassment directed at a specific person that serve no legitimate purpose and cause substantial emotional distress in the reasonable person. However, in this case, cyber stalking is accomplished electronically. In Florida, cyber stalking means to engage in a course of conduct designed to communicate or cause to be communicated words, images, or language by or through the use of email or any other form of electronic communication directed at a specific person. This conduct also causes substantial emotional distress to the person and serves no legitimate purpose, just as with stalking. Cyber stalking is considered a first-degree misdemeanor in Florida and is punishable by up to 364 days in jail. Similarly, aggravated cyber stalking is a third-degree felony and is punishable by up to five years in state prison.
